This website is operated by Portobello Road Princess . Throughout the site, the terms “we”, “us” and “our” refer to Portobello Road Princess . Portobello Road Princess offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

By accessing or using any part of the site, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services. If these Terms of Service are considered an offer, acceptance is expressly limited to these Terms of Service.

Please read our terms and conditions carefully. Your use of the Portobello Road Princess website and purchase of our products on it means that you agree to the following terms and conditions. The laws of England and Wales apply.

1. PLACING AN ORDER

1.1 When you place an Order for a Product in any of the ways listed above you are agreeing to buy it for the price stated, subject to these Terms.

1.2 When you place an Order online we will send you and email to confirm that we have received it. This email confirmation will be produced automatically so that you have confirmation of your Order details. The fact that you receive an automatic confirmation does not necessarily mean that we will be able to meet your Order. If a Product is not available we will endeavour to let you know via email.

1.3 Portobello Road Princess reserves the right to cancel any sale and not supply Products if it is reasonable to do so and may change or discontinue the availability of Products at any time at its sole discretion. If an order is cancelled, any payment made for the Products will be refunded in full. This does not affect your Statutory Rights.

1.4 All new Orders are deemed separate and each is treated individually.

1.5 We endeavour to ensure that all prices on Portobello Road Princess are accurate but errors may occur. If we discover an error in pricing of the Products in your order we will inform you as soon as possible using the contact details you have supplied us with. We will then give you the option of re-confirming your Order at the correct price or cancelling it. (If we are unable to reach you we will treat the Order as cancelled). If an Order is cancelled, any payment made for the Products will be refunded in full.

1.6 Prices are quoted on Portobello Road Princess in UK Pounds Sterling – outside the UK your credit card company will charge you in your local currency at the current rate. Please note that both charges and refunds are in UK Pounds Sterling and Portobello Road Princess cannot be held responsible for any loss due to exchange rate fluctuations.

2. PAYMENTS

2.1 You must pay for your Order before it is delivered and you can do so by credit card, debit card, cheque, Postal Order or BACS. We regret that we cannot accept Visa Electron Cards on site.

2.2 If your delivery address is outside the UK and you order online you must pay by credit card.

3. CREDIT CARDS

3.1 Orders may be processed online or via email using a credit or debit card (Visa, MasterCard, American Express, Delta and Switch/Solo).

3.2 To ensure that shopping online is secure, we do not store our customers financial details. All credit/debit card are encrypted and processed via Paypal to ensure that these details cannot be intercepted by a third party.

3.3 Your credit card company may also carry out security checks to confirm that your order is genuine.

3.4 All Orders are subject to our own security and credit card verification procedures. Portobello Road Princess reserves the right to withhold any Order that has failed to be verified. Should there be any problem with verification of your card details you will be notified via email.

4. AVAILABILITY

5.1 We endeavour to keep Portobello Road Princess as up to date as possible but cannot guarantee that a particular Product will always be available. If we are unable to supply a Product you will be refunded for it or offered an alternative.

5.2 All offers are available while stocks last. If we are unable to supply a Product you have Ordered, we will notify you via email, where possible, and will either refund you for that item or provide you with further information regarding future availability.

5. DELIVERY

6.1 Portobello Road Princess delivers to destinations inside and outside the UK.

6.2 Postage within the UK is Free of Charge.

International orders will carry a shipping surcharge.

6.3 Delivery outside the EU may be subject to local import taxes, which are your responsibility when they apply. Unfortunately we cannot advise you what these charges will be and Portobello Road Princess is not responsible for them.

6.4a Orders are dispatched either via Royal Mail (Signed for) o. A signature is required for Royal Mail special delivery, so please specify an address where someone will be able to sign for your parcel.

6.4b Delivery times as follows: within UK 2 – 3 working days, Overseas 5-10 working days. Orders placed after 3pm (weekdays) will be dispatched the next day. Orders placed Sat/Sun will be dispatched on the next working day (excluding bank holidays). All orders for Royal Mail Special Delivery next day have to be received before 1.30pm after this time Royal Mail Special Delivery next day will be processed the following day.An item cannot be treated as lost/undelivered until 15 working days after item dispatch date.20 working days for overseas orders.

6.5 We can only track orders sent via Royal Mail Signed for. Those sent via Royal Mail standard delivery cannot be tracked.

6.6 We will make every effort to deliver within the time stated on Portobello Road Princess but we will not be liable for any loss caused to you by late delivery.

6.7 Please Order from Portobello Road Princess with enough lead-time to prevent any loss or disappointment resulting from the delivery time as Portobello Road Princess cannot be responsible for this.

6.8 This does not affect your Statutory Rights as the consumer.

6. COPYRIGHT AND TRADE MARKS

7.1 All content of this site, including text, images, source codes, logos, icons and photos and all other material, is the property of Portobello Road Princess or its content providers and is protected by the United Kingdom and international copyright laws.

7.3 Permission is granted to print and electronically copy portions of the Portobello Road Princess site for the sole purpose of placing an order with Portobello Road Princess or using this website as a shopping resource. Any other use of this website and its materials, including reproduction for purposes other than those noted above, modification, distribution, or republication without the prior written permission of Portobello Road Princess, is strictly prohibited.

7.4 Portobello Road Princess does not make any warranty or representation in respect of any other trade mark and the trade marks of the brands featured on Portobello Road Princess belong to their respective owners.

7. PRIVACY AND DATA PROTECTION

8.1 Portobello Road Princess is committed to protecting your privacy and promises only to use information collected about you in accordance with the Data Protection Act 1998..

8.2 When you place an Order, we may ask you for certain information and you may submit personal data to Portobello Road Princess (for example your name, phone number, postal address, email address, contact and bank/credit card details). We may also record which Products you are interested in and which Products you purchase as well as customer traffic patterns and site use. This information will be kept securely in accordance with our internal security policy and may be used to: a) process your Order b) provide you with an up to date, efficient and reliable service c) help to prevent fraud i.e. we check card details with our merchant card checking facility and reserve the right to refuse Orders on that basis d) open and run your membership e) provide a more tailor made shopping experience.

8.3 By making an Order and submitting your data you agree to this use.

8.4 We will never collect sensitive information about you without your explicit consent.

8.5 At no time will any information gained about you be passed on to any third-party for marketing purposes.

8 RETURNS

9.1 You have the right to cancel your order at any time up to 7 working days after the day following the delivery of the goods by contacting Portobello Road Princess direct by email, post or telephone. Your right to cancel is on the basis that we will be able to re-sell the goods to another customer as new. If you have any questions about the goods or need help on deciding whether or not to keep them, please contact Customer Services for more information.

9.2 We do accept goods back at Portobello Road Princess, however only in the following circumstances:

We accept goods back, for any reason, that have been unused.

We cannot accept goods back that have been used.

All goods must received back to Portobello Road Princess in the original packaging and resalable condition, including all labelling and pricing.

9.3 If the products have already been posted to you (or on your behalf to any other person), you (or the other person) must return the products to us at the time of cancellation and we will credit your credit or debit card with the price of the products within 30 days beginning with the day on which notice of cancellation was given.

9.5 If you have received the wrong goods, we will make sure that you receive the correct goods at no extra cost, and will bear all costs for the return of the products. 9.6 If your item/s have been damaged in transit, please inform us within

Portobello Road Princess recommends that returns are sent via a method of recorded delivery as we cannot be held responsible for undelivered items. Please note that Portobello Road. Princess will not be liable for the cost of returning the item.

On receipt of the damaged items Portobello Road Princess will send out a replacement immediately.

9. RESPONSIBILITIES

10.1 Portobello Road Princess has endeavoured to make the descriptions (including all images) of the Products as accurate as possible but we cannot be held responsible for changes in Size, Content or Presentation of Products.

10.2 Portobello Road Princess will not be liable in any amount for failure to perform any obligation under this agreement if such failure is caused by the occurrence of any unforeseen event beyond its reasonable control including without limitation Internet outages, communication outages, fire, flood, war or act of God.

10.3 These Terms do not affect your Statutory Rights as a consumer.

10.4 Subject as aforesaid, to the maximum extent permitted by law, Portobello Road Princess excludes liability for loss or damage of any kind howsoever arising, including without limitation any direct, indirect or consequential loss whether or not such loss arises out of any problem you notify to Portobello Road Princess and Portobello Road Princess shall have no liability to pay any money by way of compensation, including without limitation all liability in relation to:

any incorrect or inaccurate information on Portobello Road Princess;
any interruptions to or delays in updating Portobello Road Princess;
the infringement by any person of any Intellectual Property rights of any third party caused by their use of Portobello Road Princess or any Product purchased through Portobello Road Princess;
any loss or damage resulting from your use of inability to use the Portobello Road Princess website or resulting from unauthorised access to, or alteration of your transmissions or data in circumstances which are beyond our control;
any loss of profit, wasted expenditure, corruption or destruction of data or any other loss which does not directly result from our error;
any amount or kind of loss or damage due to viruses or other malicious software that may infect a user’s computer equipment, software, data or other property caused by persons accessing, using or downloading Portobello Road Princess, or from transmissions via emails or attachments received from Portobello Road Princess;
all representations, warranties, conditions and other terms which but for this notice would have effect.

10. Liability

11.1 The Portobello Road Princess site is provided by us without any warranties or guarantees. You must bear the risks associated with the use of the Internet. If we are informed of any inaccuracies in the material on the Portobello Road Princess we will try to correct them as soon as we can.

11.2 In particular we are not liable to you for the following:

11. General

12.1 Portobello Road Princess may change or withdraw any part of Portobello Road Princess, or may refuse you access to the web site at any time if we consider it necessary.

12.2 Portobello Road Princess may also terminate this Agreement and immediately remove, cancel or suspend access to and use of Portobello Road Princess upon breach of any part of these Terms whatsoever.

12.3 Termination shall be without prejudice to Portobello Road Princess’s other rights.

12.4 Portobello Road Princess acts as a principal on its own account and not as an agent for you or any other person.

12.5 If Portobello Road Princess does not enforce any provision of this agreement such will not be considered a continuing waiver.

12.6 In the event that any part of these Terms is held to be unenforceable, such part will at Portobello Road Princess’s option be construed as far as possible to reflect the parties’ intentions and the remainder of the provisions will remain in full force and effect.

12.7 These Terms constitute the full agreement between you and Portobello Road Princess and may only be amended in writing. They apply to the exclusion of all other Terms or Conditions of contract proposed.
